# **Terms of Service**

Version 1.0, effective 10 September 2026

## **1. Who we are**

These Terms are a contract between you and Oleksandr Tykhonov, running a sole proprietorship under the name Oleksandr Tykhonov, registered in the Polish Central Register of Business Activity (CEIDG), NIP 9542859404, REGON 526238763, address ul. Tunelowa 22E, 40-676 Katowice, Poland ("Harder", "we", "us").

Contact: [~~support@harder.pro~~](https://harder.pro/mailto:support@harder.pro) (general and complaints), [~~privacy@harder.pro~~](https://harder.pro/mailto:privacy@harder.pro) (personal data), [~~legal@harder.pro~~](https://harder.pro/mailto:legal@harder.pro) (legal notices and reports of illegal content).

## **2. What these Terms cover **

Harder is a social challenge platform available as an iOS app, a web application at [~~harder.pro~~](https://harder.pro/), and related services (together, the "Service"). These Terms apply to everyone who creates an account or uses the Service, whether as a participant, creator, or visitor.

Additional documents that form part of the contract:

- Privacy Policy ([~~harder.pro/privacy~~](https://harder.pro/privacy))
- Consumer Health Data Privacy Policy ([~~harder.pro/consumer-health-data-privacy~~](https://harder.pro/consumer-health-data-privacy))
- Any price list or plan description shown when you buy a paid feature

If you use the iOS app, Apple's standard End User License Agreement also applies to the app as a piece of software. Where these Terms and Apple's EULA conflict, these Terms apply to the Service and Apple's EULA applies to the app binary.

## **3. Definitions**

- ****Account****: your registration with the Service.
- ****Space****: a public profile through which you take part in challenges, follow others, and publish content. Every Account has at least one Space.
- ****Challenge****: a structured set of actions with a start date and, optionally, an end date, created by a user or by Harder.
- ****Action****: a task inside a Challenge, with a schedule and a proof requirement.
- ****Proof****: text, an image, a video, or an aggregate reading from a health app, submitted to show that an Action was completed.
- ****User Content****: everything you upload or post, including Challenges, Actions, Proofs, comments, messages, Space descriptions, and images.
- ****Creator****: a user who publishes paid Challenges or sells Templates through the Creator Program.
- ****Template****: a reusable Challenge blueprint offered in the marketplace.
- ****Consumer****: a natural person using the Service for purposes not connected with their trade or profession.

## **4. Eligibility and Account **

4.1 You must be at least 16 years old. We ask for your date of birth at registration and refuse accounts that do not meet this requirement. Providing a false date of birth is a breach of these Terms.

4.2 You may hold one Account. You may create several Spaces inside it.

4.3 You are responsible for keeping your login details safe and for everything that happens under your Account. Tell us at [~~support@harder.pro~~](https://harder.pro/mailto:support@harder.pro) if you think someone else has accessed it.

4.4 You may register with an email and password, or through Google or Apple sign-in, or with a passkey. Third-party sign-in is governed by that provider's terms as far as the sign-in itself is concerned.

4.5 The contract for the free Service is concluded when you complete registration and accept these Terms. It runs for an indefinite period and you can end it at any time by deleting your Account (section 15).

## **5. The Service**

5.1 Free features include creating and joining Challenges within the limits of the free plan, Spaces, following, comments, direct messages, and the discovery feed.

5.2 Paid features may include subscription plans with higher limits, entry to paid Challenges, Templates sold by Creators, and the Creator Program. Paid features are described in section 10 and on the plan pages. Some paid features may not be available in the iOS app.

5.3 We may add, change, or remove features. If a change materially reduces a paid feature you have already paid for, section 14 (digital content conformity) and section 18 (changes) apply.

5.4 Technical requirements: a device running a supported version of iOS, or a current version of a major web browser with JavaScript and cookies enabled, and an internet connection. Health data verification additionally requires Apple Health on a compatible device.

5.5 We aim for high availability but do not guarantee uninterrupted access. We may suspend the Service for maintenance, security, or reasons outside our control. Planned maintenance is announced in advance where reasonably possible.

## **6. Your content**

6.1 You keep ownership of your User Content.

6.2 You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, adapt for display, and publicly display your User Content, only to the extent needed to operate, promote, and improve the Service. For content in personal or private Challenges, "publicly display" means display to the people you have allowed to see it. The licence ends when you delete the content or your Account, except for copies that remain in backups for up to 30 days and content that others have already shared inside the Service in accordance with your visibility settings.

6.3 You confirm that you have the rights needed to post your User Content and that it does not infringe anyone's rights.

6.4 Visibility. A Challenge can be personal, private, public, or public with approval. Proofs and comments follow the visibility of the Challenge. Your Space profile is public. Direct messages are visible only to the two Spaces in the thread and to us where needed for moderation or safety.

6.5 Other users may see your Proofs, including verified health readings such as a step count, inside the Challenges you take part in. Do not post anything you are not comfortable sharing with the participants of that Challenge.

## **7. Community rules**

You may not post or do any of the following on the Service:

- a) content that is illegal in Poland, in the EU, or in the country where you are;
- b) content that sexualises minors in any form, or that grooms, exploits, or endangers a minor;
- c) threats, harassment, bullying, or content that targets a person or group with hatred based on a protected characteristic;
- d) content that promotes self-harm, suicide, eating disorders, or dangerous activities, or that presents them as a challenge;
- e) graphic violence or gore;
- f) sexually explicit content;
- g) content that infringes copyright, trademarks, or other rights;
- h) spam, scams, pyramid schemes, or deceptive commercial content;
- i) malware, attempts to break, overload, scrape, or reverse-engineer the Service, or use of automated tools to create accounts or submit Proofs;
- j) impersonation of another person, organisation, or of Harder;
- k) fake Proofs, manipulated health data, or any attempt to cheat a verification;
- l) sharing another person's private information without their consent;
- m) medical, financial, or legal claims presented as professional advice inside a Challenge.

Challenges must be safe to complete by an ordinary healthy adult. We may remove Challenges that involve fasting beyond medically accepted limits, extreme weight loss targets, substance use, or similar risks.

## **8. Moderation, reports, and appeals **

8.1 How we moderate. We use a combination of automated tools and human review. Automated tools, including artificial intelligence models, scan text and images for the categories in section 7 and give a confidence score. Depending on the score, content may be flagged for human review, hidden, or removed automatically. A person reviews flagged content and appeals. We do not use automated tools to make decisions about your Account status; a person decides suspensions and terminations.

8.2 Reporting. Any user can report a Challenge, Space, user, message, or comment through the in-app report function. Anyone, including non-users, can report illegal content by email to [~~legal@harder.pro~~](https://harder.pro/mailto:legal@harder.pro). Include a link or description of the content, the reason you consider it illegal, your name and email, and a statement that your report is made in good faith. We confirm receipt and inform you of the outcome.

8.3 Measures we may take: remove or hide content; restrict visibility; limit a feature (for example messaging); suspend a Space or Account temporarily; terminate an Account for serious or repeated breaches.

8.4 Statement of reasons. When we remove or restrict your content or Account, we tell you what we did, which rule was breached, whether the decision was based on a report or on our own detection, whether automated tools were involved, and how to appeal. We do not give this notice where doing so would break the law or endanger someone.

8.5 Appeals. You can appeal any moderation decision within 6 months by replying to the notice or writing to [~~legal@harder.pro~~](https://harder.pro/mailto:legal@harder.pro). A person who was not involved in the original decision reviews the appeal and answers within 14 days.

8.6 Repeated misuse of the report function (clearly unfounded reports) may itself lead to restrictions after a warning.

8.7 Where we become aware of content that gives rise to a suspicion of a serious crime involving a threat to life or safety, we may inform law enforcement.

## **9. Proofs, verification, and health **

9.1 Proofs are your own statement that you completed an Action. Verification badges, including health data verification, mean that a reading matched the rule set by the Challenge creator. They are not a medical, scientific, or legal certification of anything.

9.2 Health data verification is optional. It requires your separate explicit consent inside the app and permission in Apple Health. You can withdraw consent at any time in Settings. Withdrawal deletes the stored health readings; your completed days stay completed. Details are in the [~~Privacy Policy~~](https://harder.pro/privacy).

9.3 Not medical advice. Challenges are created by users. Nothing on the Service is medical, nutritional, psychological, or fitness advice. Consult a doctor before starting any physical or dietary Challenge, especially if you have a health condition, are pregnant, or are recovering from injury. You take part at your own risk and are responsible for judging what is safe for you.

9.4 We do not verify the identity, qualifications, or claims of Challenge creators unless we say so explicitly for a specific creator badge.

## **10. Paid features**

10.1 Prices. Prices are shown before purchase in the currency indicated, including VAT where applicable. The price you see at the moment you confirm the purchase is the price you pay.

10.2 Payment. Payments on the web are processed by Stripe. Payments in the iOS app, where offered, are processed by Apple through In-App Purchase and are subject to Apple's terms, including Apple's refund process. We do not store card numbers.

10.3 Subscriptions. A subscription renews automatically at the end of each billing period (monthly or yearly) until you cancel. You can cancel at any time in the billing portal or, for App Store subscriptions, in your Apple ID settings. Cancellation takes effect at the end of the current period; you keep access until then. We tell you at least 30 days in advance before a price increase takes effect, and you can cancel before it applies.

10.4 Paid Challenge entry. Some Challenges require an entry fee set by the Creator. The fee, the minimum number of participants (if any), and the start date are shown before payment. If a Challenge with a minimum participant number does not reach it by the start date, we refund the fee in full.

10.5 Templates. Templates are digital content. Buying a Template creates a copy of the Challenge in your Space for your own use. You may not resell or redistribute a Template.

10.6 Plan limits. The free plan and each paid plan have limits (for example the number of Challenges per month). Limits are shown on the plan pages and reset monthly.

10.7 Taxes. Prices to Consumers include VAT where applicable. Creators are responsible for their own taxes on income received through the Creator Program.

## **11. Right of withdrawal and refunds **

11.1 Consumers in the EU have the right to withdraw from a distance contract within 14 days without giving a reason.

11.2 Digital content and services supplied immediately. When you buy a subscription, Template, or Challenge entry, we start providing the digital content or service immediately. Before payment we ask you to confirm that you want immediate access and that you understand you lose the right of withdrawal for digital content once it has been delivered, and, for services, that you will owe a proportionate amount for the period already used if you withdraw. If you do not give this confirmation, access starts after the 14-day period.

11.3 Model withdrawal statement. To withdraw, send a clear statement to [~~support@harder.pro~~](https://harder.pro/mailto:support@harder.pro). You may use this wording: "I withdraw from the contract for [subscription / Template / Challenge entry] purchased on [date], account email [email]." We confirm receipt and refund within 14 days using the original payment method.

11.4 Paid Challenge refunds beyond the legal right. You may cancel your entry to a paid Challenge for a full refund at any time before its start date or, for a Challenge without a start date, within 24 hours of payment. After that, entry fees are non-refundable except where section 14 (non-conformity) applies or the Creator or we cancel the Challenge.

11.5 Subscriptions after the withdrawal period are refundable only in the cases described in section 14 or where required by law. App Store purchases are refunded by Apple under Apple's rules.

11.6 Nothing in this section limits your legal rights as a Consumer.

## **12. Creator Program **

12.1 To receive payments you must complete onboarding with our payment partner (Stripe Connect), which includes identity verification. Stripe's Connected Account Agreement applies.

12.2 Platform fee. We keep a platform fee, shown in the Creator dashboard at the time you publish a paid Challenge or Template, from each sale. The rest is paid out to you according to the payout schedule in the dashboard.

12.3 Refunds and chargebacks made under section 11 or by a card issuer are deducted from your balance. You must not set prices that mislead buyers or promise results you cannot deliver.

12.4 You must have the rights to everything in a paid Challenge or Template. You grant buyers a personal, non-transferable licence to use the Template within the Service.

12.5 We may suspend payouts where we suspect fraud, chargeback abuse, or a breach of these Terms, and we tell you why unless the law prevents it.

12.6 Grace period. If a subscription that your Creator status depends on lapses, we give you a grace period shown in the app before published paid Challenges are archived.

## **13. Our intellectual property **

The Service, its software, design, logos, the name Harder, and any content we create are our property or licensed to us. You may use them only as part of the Service. You may not copy the Service, use our marks without permission, or build a competing product from our data. Feedback you send us may be used without obligation to you.

## **14. Conformity, liability, and warranties **

14.1 Consumers. As a Consumer you have the legal right to digital content and services that conform to the contract. If a paid feature does not work as described, you can ask us to fix it. If we cannot fix it within a reasonable time, you may ask for a price reduction or end the contract for that feature and receive a proportionate refund. We provide updates needed to keep paid features working for the period you have paid for.

14.2 Our liability to you is not limited for death, personal injury, intentional misconduct, gross negligence, or where the law does not allow limitation.

14.3 Subject to 14.1 and 14.2, we are not liable for: content created by other users; your reliance on a Challenge, Proof, or verification; decisions you take about your health or fitness; loss caused by events outside our reasonable control; or indirect losses such as lost profits, where you use the Service for business purposes.

14.4 Where you use the Service for business purposes (for example as a Creator or a company running a wellness programme), our total liability for any claim is limited to the amount you paid us in the 12 months before the event, unless 14.2 applies.

14.5 The free Service is provided as is, to the extent the law allows, without excluding Consumer rights.

## **15. Ending the contract **

15.1 By you. You can delete your Account at any time in Settings. Deletion is immediate and cannot be undone. It cancels active subscriptions at the end of the paid period, deletes your Spaces, Challenges, Proofs, health readings, messages, and consent records, and revokes all sessions. Content that other users copied into their own Spaces under your visibility settings (for example a Template they bought) is not affected.

15.2 By us. We may terminate your Account with 14 days' notice by email if you breach these Terms and do not remedy the breach after a warning. We may suspend or terminate immediately, without prior warning, for serious breaches: illegal content, content involving minors, fraud, security attacks, or where required by law or by an authority. We give a statement of reasons under section 8.4.

15.3 After termination, sections 6.2 (backup copies), 13, 14, 17, and 19 continue to apply.

## **16. Complaints**

16.1 You can complain about any aspect of the Service to [~~support@harder.pro~~](https://harder.pro/mailto:support@harder.pro) or by post to the address in section 1. Describe the problem, your account email, and what outcome you want.

16.2 We respond within 14 days of receiving a complaint from a Consumer. If we do not respond in that time, the complaint is treated as accepted.

## **17. Out-of-court dispute resolution **

Consumers may use out-of-court complaint and redress procedures. In Poland: the municipal or district Consumer Ombudsman (rzecznik konsumentów), and the alternative dispute resolution procedure run by the Provincial Inspectorates of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). Information is available at [~~uokik.gov.pl~~](https://uokik.gov.pl). Consumers in other EU countries may use the ADR bodies of their own country. Use of these procedures is voluntary for both sides.

## **18. Changes to these Terms **

18.1 We may change these Terms for good reasons: changes in law, new or changed features, security, or clarification. We give you at least 14 days' notice by email or in-app message before changes take effect, with a summary of what changed. If you do not accept the changes, you can end the contract by deleting your Account before they take effect. Continued use after the effective date means acceptance.

18.2 Changes that only add features, fix errors, or are required by law may take effect immediately with notice.

18.3 Each version is dated. Previous versions are available on request.

## **19. Governing law and jurisdiction **

19.1 These Terms are governed by Polish law.

19.2 If you are a Consumer, you also benefit from the mandatory consumer protection rules of the country where you live, and you may bring claims in the courts of that country.

19.3 For business users, the courts of the place where we are registered have exclusive jurisdiction.

## **20. Language and final provisions **

20.1 These Terms are published in English and Polish.

20.2 If any part of these Terms is found invalid, the rest remains in force.

20.3 You may not transfer your Account or rights under these Terms to anyone else. We may transfer the contract to a successor of our business with notice to you, and you may end the contract if you do not agree.

20.4 Notices to you go to the email address on your Account. Notices to us go to the addresses in section 1.
